Mums Who Build - Terms and Conditions

1. Who We Are

Mums Who Build (also referred to as "MOB", "we", "us" or "our") is a limited company registered in England and Wales with company number 16287244, operating a community platform for mums building businesses, careers, and financial independence. We offer digital resources, paid membership access (MOB+), WhatsApp community groups, events, peer support, and content through our website www.mumswhobuild.com, emails, social channels and other digital properties (collectively, the "Platform").

By accessing or using the Platform and associated services, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use the Platform.

2. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or legal obligations. The latest version will always be posted on our website. Continued use of our Platform after changes means you accept the updated Terms.

3. Your Account and Access

Some parts of our Platform require registration (such as joining MOB (free content) or MOB+ £4.99 subscription). You agree to provide accurate, up-to-date information and to keep your login details confidential. We reserve the right to suspend or remove access at any time, particularly where use breaches these Terms.

You must be 18 or older to join MOB or MOB+, access our communities or attend our events. By accessing the Platform, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age at any time, and to suspend or terminate accounts where we reasonably believe users are under 18.

4. MOB+ Membership

MOB+ is our paid monthly membership for mums seeking more support, action, growth, and connection. By subscribing, you agree:

  • To pay £4.99/month via GoCardless (or another method we may offer).

  • Your membership automatically renews monthly until cancelled. You will be charged the then-current membership fee (currently £4.99/month) at the beginning of each billing period unless you cancel at least 48 hours before the next renewal date. You can cancel anytime after the first payment has been processed, by contacting mobster@mumswhobuild.com Upon cancellation, you will retain access to membership benefits until the end of your current billing period, with no refunds for partial periods.

  • To treat all community interactions confidentially and respectfully.

·   You may not: * Copy, reproduce, adapt or distribute our content for commercial purposes. * Use our brand or logo without written permission. * Share MOB internal resources or community content externally, unless authorised by MOB Co-founders Rebecca Coxshall or Georgie Harris.

 

We reserve the right to suspend or cancel your membership if you breach these Terms or community guidelines.

5. WhatsApp Community Guidelines

Participation in MOB+ WhatsApp groups is a privilege, not a right. By joining, you agree to:

  • Be kind, respectful and inclusive.

  • Not share promotional content, spam, or unsolicited services unless invited or on the appropriate promotion day.

  • Not share screenshots or private conversations outside the group.

  • Follow admin instructions and respect group topics.

  • No recruitment

We reserve the right to remove any member who breaches these guidelines without refund.

6. Events and In-Person Gatherings

Event tickets may be subject to separate terms and cancellation policies. By attending any MOB event, you agree to:

  • Respect the physical and emotional safety of all attendees.

  • Follow any health and safety guidance shared in advance.

  • Grant permission (unless opted out) for MOB to use event photos/videos in marketing.

We may refuse entry or remove individuals from events who breach our values or pose a risk to others.

7. Content and Intellectual Property

All content provided via the Platform (including but not limited to text, videos, branding, logos, images, resources, trademarks, and trade names) is owned or licensed by Mums Who Build and is protected by intellectual property laws including copyright and trademark laws. The "Mums Who Build" name and logo are trademarks of Mums Who Build. Nothing in these Terms grants you a right or license to use any Mums Who Build trademark, logo, or other branding elements.

You may not: * Copy, reproduce, adapt or distribute our content for commercial purposes. * Use our brand or logo without written permission. * Share internal resources or community content externally.

You retain ownership of any content you contribute, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Platform and our business, including for promoting and redistributing part or all of the Platform. This license continues even if you stop using our Platform, but you may contact us to request removal of specific content where reasonable.

8. Acceptable Use

You must not use our Platform or communities to:

  • Post or promote hate speech, harassment, abuse or discrimination.

  • Misrepresent your identity or intentions.

  • Interfere with the experience of others.

  • Engage in unlawful or fraudulent activity.

We may suspend access and/or report activity to appropriate authorities where required.

9. External Links and Third Parties

Our Platform may include links to third-party websites or services (e.g., partner offers, payment processors). We're not responsible for the content, availability or policies of these external sites. Use them at your own risk.

10. Limitation of Liability

We do our best to offer reliable, supportive services - but:

  • We do not guarantee uninterrupted access to the Platform.

  • We do not offer legal, financial or business advice; content is for general support and education only.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. Our total liability for all claims related to the Services shall not exceed the greater of £100 or the amount you paid to us during the past 12 months.

Nothing in these Terms limits our liability for death, personal injury or fraud caused by our negligence.

11. Privacy and Data

We collect and process your personal data in accordance with our Privacy Policy, which explains your rights under data protection laws including the UK GDPR and Data Protection Act 2018. Our legal basis for processing your data includes contract performance, legitimate interests, legal obligations, and consent where applicable. You have rights to access, correct, delete, restrict processing, and object to processing of your personal data as detailed in our Privacy Policy.

12. Termination

You can stop using our services at any time. We may suspend or terminate your access immediately if you breach these Terms or community rules.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Before commencing formal legal proceedings, we encourage you to contact us at mobster@mumswhobuild.com to attempt to resolve any disputes informally. If informal resolution is not possible, any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mums Who Build, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

15. Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control, including but not limited to acts of God, disease outbreaks, epidemics, pandemics, strikes, lock-outs or other industrial action, civil commotion, riot, terrorist attack, war, fire, explosion, storm, flood, earthquake, subsidence, or other natural disaster.

16. Refund Policy

Unless otherwise required by applicable law, payments for MOB+ membership are non-refundable. For event tickets, refunds may be available as specified in the event-specific terms. In exceptional circumstances, we may consider refund requests at our sole discretion. Please contact mobster@mumswhobuild.com with any refund inquiries.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.
